These Terms of Service ("Terms") govern your use of www.jyushinka.shop and your engagement with JYUSHINKAN, LLC ("JYUSHINKAN", "we", "us"), a limited liability company located at 1480 Sumac Dr, Logan, UT 84321, United States. By using this website or submitting a program inquiry, you accept these Terms. If you do not agree, do not use the site.
JYUSHINKAN operates programs across three divisions: professional and semiprofessional clubs and teams; racetrack and speedway operations; and independent athlete, stable, owner, trainer, driver, scout and official engagements.
JYUSHINKAN is not a league, sanctioning body, racing commission or licensing authority. Programs operate under the rules of each sport's governing organizations, whose decisions on eligibility, competition and discipline are independent of ours.
Content on this website — including the program roster — describes the types of programs we operate. It is not an offer, a roster announcement, a fixture guarantee, or a promise to engage any specific person or organization.
No person or organization is engaged by JYUSHINKAN except under a written agreement signed by both parties. Email exchanges, scout report submissions and phone conversations do not create an engagement.
Participants are responsible for holding and maintaining all licenses, registrations, medical clearances and governing-body eligibility required for their program. We may suspend or decline a program where compliance cannot be verified.
Unless a written agreement states otherwise, athletes, trainers, drivers, officials and other participants are independent contractors, not employees of JYUSHINKAN.
Participants must comply with the rules of their sport, applicable law, and venue regulations. JYUSHINKAN reserves the right to terminate or suspend any program for conduct that violates governing-body rules, anti-doping codes, betting and match-fixing prohibitions, or that endangers safety or the integrity of an event.
Sport and racing involve inherent physical risk. Participants engage at their own risk and are responsible for their own insurance coverage unless a written agreement states otherwise.
To the maximum extent permitted by law, JYUSHINKAN's aggregate liability arising out of the website or any engagement is limited to the amounts paid or payable to you under the applicable written agreement in the twelve months preceding the claim. We are not liable for indirect, incidental or consequential damages, lost purses, lost opportunities or lost profits.
The website is provided "as is" without warranties of any kind. We do not warrant uninterrupted availability, error-free content, or that the roster reflects current program availability.
All site content — text, design, graphics, the "Scoreboard" visual system and the JYUSHINKAN name and pennant mark — is owned by JYUSHINKAN, LLC or its licensors. You may not reproduce it without written permission. Club, league, sanctioning-body and venue names referenced on this site belong to their respective owners; reference does not imply endorsement.
The site is hosted on third-party infrastructure and may link to governing bodies, venues or partners. We are not responsible for third-party content, availability or practices.
You agree to indemnify and hold JYUSHINKAN harmless from claims, losses and expenses arising from your breach of these Terms, your violation of any sport's rules or applicable law, or your engagement-related conduct, except to the extent caused by our own misconduct.
We may suspend or terminate website access at any time. Program engagements terminate per their written agreements. Provisions on liability, indemnification, disputes and governing law survive termination.
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Disputes not resolved informally shall be brought in the state or federal courts of Cache County, Utah, and both parties consent to that jurisdiction. Where a written agreement specifies arbitration or another forum, the agreement controls.
We may update these Terms at any time. The current version is posted at this page; continued use of the website after changes constitutes acceptance. Written engagement agreements are not modified by changes to these website Terms.
If any provision is held unenforceable, the remainder of these Terms remains in effect.
